The plaintiffs were travelling to assemble at the meeting venue of the cabinet, in order to appeal the cabinet’s decision approving the Thailand-Malaysia Gas Pipeline project. The police force obstructed the plaintiffs on the way to the venue and persuaded the plaintiffs to change the place of assembly. After the negotiations failed, the police used force to dissolve the group of plaintiffs and other demonstrators. The court found that the assembly was peaceful and the act of the police was committed without legitimate ground. The act thus constituted the violation of the right of peaceful assembly and tort, and the defendants had to pay compensation to the 1st – 24th plaintiffs in total of 100,000 THB.
