These Regulations provide for the specification, modification, discharge and enforcement of Planning Obligations in terms of section 40 the Development Control Act and entered into by public deed. A Planning Obligation may be unconditioned or subject to conditions. And may be for a specified period or be for an indefinite period (reg. 3). A Planning Obligation shall be enforceable by the Authority against persons entering into an obligation or persons acquiring a property on which the obligation
