This Directive lays down several amendments and addenda to Directive 95/21/EC concerning the enforcement, in respect of shipping using Community ports and sailing in the waters under the jurisdiction of the Member States, of international standards for ship safety, pollution prevention and shipboard living and working conditions (port State control). Firstly, hereinafter the Title of such Directive shall be the following: Directive 95/21/EC of the Council of 19 June 1995 on port State control of shipping . Secondly, the International Convention on Civil Liability for Oil Pollution Damage of 1992 is added to the list of article 2 of the international agreements which shall be taken into account in the implementation of this Directive. Further, the following articles are hereby replaced: 4, 7, 8, 17 and 18. These provisions mainly concern inspection body, mandatory expanded inspection of certain ships, report of inspection to the master, data to monitor implementation and the Regulatory Committee which assist the Commission. New provisions are added, namely: article 7a on the procedure in case certain ships cannot be inspected; article 7b on access refusal measures concerning certain ships; article 19a relating to the system of penalties to be adopted by Member States. Lastly, Annex IV to this Directive contains the new four Annexes which shall be inserted after Annex VIII to Directive 95/21/EC. Annex IX regards the inspection report drawn up in accordance with article 8; Annex X is concerned with data provided in the context of monitoring implementation in application of article 17; Annex XI deals, on the one hand, with categories of ships subject to refusal of access to Community ports and, on the other hand, with procedures relating to refusal of access to Community ports; Annex XII specifies international and Community requirements concerning voyage data recorder systems.
