This Law may be cited as the Solid and Hazardous Waste (Amendment) Law of 2005 and shall be read as one with the Solid and Hazardous Waste Laws of 2002-2004 (hereinafter referred to as the principal Law ). The principal Law and the present Law shall be read as one and will be referred to as the Solid and Hazardous Waste Laws 2002-2005. For the purpose of implementing article 2 to Directive 2003/35/EC, the present law lays down amendments to the principal law. More specifically, it introduces new articles 9A up to 9F which concern public participation in decision-making. Article 9A provides for the interpretation and field of application of the law. Article 9B provides for public participation as regards the drawing up of certain plans and programmes in the environmental field. Article 9C establishes the procedures for public consultations. Article 9D establishes that before taking of any decision, the Cabinet of Ministers shall take into consideration amendments and addenda advanced by the public. Article 9E guarantees that the public is given early and effective notification as regards the implementation of plans or programmes. Article 9F establishes that an Archive of all plans, proposals, etc. shall be kept. The Archive shall be open to public consultation. A minor wording amendment is brought forth in article 5.
