Abstract:

Environmental advocates argued that permission for a new coal mine should be conditional on that mine offsetting 100% of its expected Scope 3 GHG emissions. The Tribunal rejected this argument after raising questions about the validity of the Stern Review and the Fourth Assessment Report of the Inter-governmental Panel on Climate Change.
