Abstract:
The court established that the cause of the damage affecting the plaintiff results from the company’s reckless behavior during sewage treatment
which caused the sewage to infiltrate the plaintiff’s land and damaged his agriculture and the well’s water inside his land, based on the legal
examination report as long as it was not established to the legal expert that the damages in the real estates and the well’s water results from
the infiltration of hydrocarbon products (La SAMIR company), and as long as REDAL did not file anything to support this defense, and thus there
was no reason to involve LA SAMIR company since the liability of REDAL company was proven.
