The applicant applied to the court to have the respondents order set aside. The respondent had ordered the applicant to stop his mining operations due to outstanding environmental fees, install dust abatement measures around the crushing area, complete paving to prevent erosion, use chemicals to neutralize accidental spillages and clean up all spillages from the tailings dam and plant. The respondents’ application to order the closure of the applicants mine was declared invalid and of no force or effect.
