Abstract:
This case dealt with a restriction in the use of a bunker owned by the applicant on the island of Jersey. The local planning authority refused to issue an official permit allowing her to own the bunker as a summer residence. This refusal was based on the concern to protect an area of special interest, the so-called “green zone“, the bunker was situated in. The court held that on the grounds of general interest, it was justified to restrict the applicant’s right to property of Article I of Protocol No. 1 and her right to respect for private and family life of Article 8 of the European Convention on Human Rights.
