Abstract:

A case concerning the restoration of the ecosystem of the Laguna del Diario.

 

The Public Prosecutor considered that the Ministry of Housing, Use of the Land and Environment did not respect its obligation to protect the environment as it did not request a restoration of the ecosystem of the Laguna del Diario even though this ecosystem has been damaged by human activities.

 

But the Court of Appeal considered that the environmental degradations on the Laguna del Diario where not exceeding the limits specified by the law on negative environmental impact and therefore dismissed the appeal.
