Abstract:

Harm has to be removed once it’s proved . The harm in this case consists on the noise emitted by the high power electric carpentry machines in the workshops situated in a residential neighborhood. Therefore the authorization issued by the qualified authorities does not prevent the removal of harm that exceed the conventional limit pursuant to Article 91 of the Obligation and Contracts Code.
