Abstract:

Landfill site – state’s private property – quality in litigation.
If the two appellees objection was right in the appealed decision because what is understood from the registrar’s attestation, the land subject of dispute is owned by the Moroccan state (private property) and the commune of Bourezouin did not establish proof that the part where the Municipality of Hajeb made the landfill was in its ownership. Therefore its quality in the litigation is not established, which makes the appealed decision mistaken and must be concealed.
