Abstract:
The plaintiffs applied to court to interdict the mining companies from releasing waste discharges into the Odzi, Singwizi and Save Rivers. The defendants contended that the plaintiffs were not entitled to such a relief because of the nature sought in that a satisfactory remedy exists in section 10(1) (b) (xiii) of the Environmental Management Act which would afford the plaintiffs the relief they seek in the instant proceedings. The judge dismissed the remedy which was sought by the defendants.
