The defendants bought the old Cobalt-60 generator machine from the hospital and stored it in its parking lot, which failed to comply with the safety standards of storage provided by law. The stainless bar in the machine containing cobalt-60 was stolen and sold to the plaintiffs. Operating as a waste dealer, the plaintiffs dissembled the lead bar, leading to the exposure of the harmful radioactive cobalt-60 which resulted in death and health damages. The Supreme Court ruled the act of the defendants gross negligence and pronounced compensation.
