Abstract:

The main issues in this case were land-use management and ecosystem disturbances. The applicant launched an urgent application to interdict the respondents to stop construction on a piece of land which was observed as a park. The applicant further contends that the respondents had disturbed the eco-balance. The interdict was not granted since the matter was not urgent.
