The scope of this Law is to establish the procedure for the expropriation of land plots or parts thereof belonging to natural persons and legal entities on the right of lifelong inheritable ownership, permanent possession, permanent use, fixed-term (temporary) use or lease, for public needs with compensation. This Law does not apply to land plots owned by natural persons and legal entities as property rights, as well as those in the permanent use of government bodies and institutions, enterprises, and self-government bodies of citizens. Public needs are recognized as the expropriation of land plots with compensation for the following purposes: (a) provision of land for defense and state security needs, protected natural areas, creation and operation of free economic zones, free trade zones; (b) fulfillment of obligations arising from international treaties of the Republic of Uzbekistan; (c) exploration and development of mineral deposits (except for deposits of common minerals); (d) construction (reconstruction) of roads and railways of national and local significance, airports, airfields, air navigation facilities and aviation technical centers, railway transport facilities, bridges, subways, tunnels, engineering facilities and lines of the energy and communications system, space activity facilities, main pipelines, engineering -communication networks, irrigation and land reclamation systems; (e) execution of approved master plans for settlements regarding the construction of facilities at the expense of the State Budget of the Republic of Uzbekistan; and (f) implementation of projects involving the construction, at the expense of centralized investments, of buildings and structures of state institutions of education, health care, culture, medical and social services specified in state investment programs. It is prohibited to interpret the expropriation of land plots for any other purposes as expropriation for public needs. The basic principles of procedures for the seizure of land plots for public needs with compensation are: (a) legality; (b) priority of property rights; (c) inviolability of private property; (d) openness and transparency; and (e) compensation guarantee. Compensation commissions shall perform the following tasks: (a) ensure regular monitoring of the timely provision of compensation in full and accounting of the compensation provided; (b) when identifying cases of untimely and incomplete provision of compensation, they enter information accordingly into the Jokargy Kenes of the Republic of Karakalpakstan, the local Kengash; (c) provide assistance in resolving pre-trial disputes related to the provision of compensation; and (d) make advisory decisions on disputes related to the provision of compensation. Terms and conditions, including the amount of compensation shall be regulated by contracts concluded by the owners of land plots subject to expropriation and the competent public authority. The types of compensation provided are: (a) funds, including for temporary rental of residential and non-residential premises; (b) provision of ownership of another real estate object; and (c) other types of compensation provided for in the contract. This Law contains 7 Chapters divided into 42 Articles. Chapter 1 lays down general provisions. Chapter 2 regards centralized funds for compensation of losses to natural persons and legal entities in connection with the expropriation of land plots for public needs and establishes the procedure on compensation commissions. Chapter 3 establishes the procedure for the expropriation of land plots for public needs with compensation and the conclusion of contract with owners of land plots. Chapter 4 establishes the procedure for providing compensation. Chapter 5 establishes the procedure for recognizing a real estate object located on expropriated land plot as ownerless property and for assessing real estate subject to demolition, as well as rights to the expropriated land plot. Chapter 6 establishes the procedure for the demolition of real estate objects located on expropriated land. Chapter 7 lays down final provisions.
