The scope of this Law is to regulate relations in the field of technical regulation. This Law applies to relationships arising from the development, adoption and application of technical regulations, conformity assessment and implementation of state control in the field of technical regulation. This Law does not apply to the following relations: (a) sanitary, phytosanitary and veterinary measures; (b) measures in the field of labor protection; and (c) standards of healthcare. Technical regulation shall be intended establishment, application and compliance with product safety requirements, processes and methods of its production, as well as verification of their compliance by evaluating compliance and implementation of state control. The main principles of technical regulation are: (a) unity of application of technical regulations; (b) inadmissibility of discrimination of business entities and unfair competition in the field of technical regulation; (c) unity and integrity of technical regulation and evaluation compliance; (d) independence of conformity assessment bodies from manufacturers, sellers and buyers (consumers); (e) unity of rules and methods of testing and measurement during mandatory conformity assessment procedures; (f) inadmissibility of combining powers by one body on state control and confirmation of conformity; and (g) inadmissibility of duplication of the same powers by two and more government control bodies. State regulation in the field of technical regulation shall be performed by: (a) Cabinet of Ministers and government agencies; (b) state technical regulation bodies; (c) authorized state bodies in the field of technical regulation; (d) state national standardization body; (e) accreditation body; and (f) technical expert commissions in the field of technical regulation, conformity assessment bodies, testing laboratories. The main directions of state policy in the field of technical regulation are: (a) ensuring compliance of technical regulation with the level of development of the economy, material and technical base, as well as the level scientific and technological development; (b) development and implementation of development programs in this field; (c) harmonization of this field with international (regional) standards; (d) introduction of advanced communication technologies; innovative and improvement of the training system, and advanced training of personnel; and (e) development of international cooperation. Technical regulations are adopted in order to: (a) protect life or health of citizens by establishing product safety requirements; (b) protect environment, flora and fauna; (c) prevent actions that mislead buyers (consumers); (c) ensure energy efficiency and rational use of natural resources; (d) prevent technical barriers to trade; and (e) increase the competitiveness of products in the domestic and foreign markets.
