This Law is enacted in accordance with the Constitution, aiming to achieve the simultaneous development of population with the economy, society, resources and environment, to carry out the family planning, to safeguard the lawful rights and interests of the citizens, and to promote happiness of the families, prosperity of the people and the advancement of society. The Law consists of 7 Chapters: General Provisions; Formulation and Implementation of Population Development Planning; Birth Regulation; Awards and Social Security; Family Planning Technology Services; Legal Liabilities; Supplementary Provisions.
It is the basic national policy to apply family planning (art.2). The State shall adopt comprehensive measures to control the population, improve the quality of the population, promote the realization of an appropriate fertility level, optimize the population structure, and promote the long-term balanced development of the population. The State Council shall prepare population development plans and incorporates them into national economic and social development plans (art.9). Villagers committees and residents committees shall do a good job in family planning according to law (art.12).
The population and family planning work should be combined with increasing women s education and employment opportunities, improving women s health, and improving women s status (art.3). During pregnancy, childbirth and lactation, women enjoy special labor protection and can receive help and compensation in accordance with relevant provisions of the state. The state protects the legitimate rights and interests of women in employment and provides employment services for women whose employment is affected by childbirth (art.26).
