These Provisions are enacted in accordance with the Food Safety Law, the Advertising Law, and the Law on the Quality and Safety of Agricultural Products, aiming to strengthen food safety supervision and management, strictly investigate and deal with illegal activities in the production and operation of food containing gold and silver foil powder, maintain the health of the people, and purify the market consumption environment.
Gold and silver foil powder is not listed in the National Food Safety Standard for the Use of Food Additives (GB 2760), and it is not a food additive, not a food raw material, and cannot be used in food production and operation. If an importer is found to violate the provisions of Article 6 of these regulations, it shall be ordered to destroy or return the goods and be investigated and dealt with in accordance with the relevant provisions of the Food Safety Law; if it is found that it has been imported, the relevant competent department shall supervise the exporter to immediately stop sales, implement a recall, and the importer who refuse to recall will be punished by the customs in accordance with the relevant provisions of the Food Safety Law.
