This Regulation, which is made of three chapters, develops article 5 of the revised text of Law 11/2016 on the possession and protection of animals and aims to protect wildlife species and ensure their conservation and control their trade. is applied respecting the objectives, principles and provisions of the Convention on trade International Convention on Endangered Species of Wild Fauna and Flora ("CITES Convention").
The provisions of this Regulation apply to the transport, import and export of live and dead animals and of products or parts derived from indigenous and non-indigenous wildlife species, with the exception of the pieces obtained through hunting and fishing activities and not annexed to the CITES Convention.
The Department of Environment and Sustainability is the administrative authority with the main responsibility for applying the CITES Convention and this Regulation and for communication with the European and international competent institutions.
The Regulation provides for the permits and certificates necessary for the imports, exports and re-exports of live animals or animal products of the fauna species annexed to the appendices of the CITES Convention. It also provides for exemptions and special provisions.
Chapter 2 regulates in detail the imports, exports, re-exports and transport rules of live and dead animals and wild native or non-native animal products.
Chapter 3 provides for procedures, control, fees and infringements.
