These Regulations give effect to provisions laid down in relation to asbestos in entry number 6 Annex XVII to the Regulation (EC) No. 1907/2006 of the European Parliament and of the Council concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH), as substituted by Commission Regulation (EC) No. 552/2009. They specify how the Health and Safety Authority (HSA) may issue or revoke a certificate to exempt an asbestos-containing article, or category of such articles, from the prohibition on the placing on the market of an asbestos-containing article provided for by Article 67 and Annex XVII of the REACH Regulation. The Regulations also provide for an appeals procedure whereby decisions of the HSA can be appealed to an appeals officer.
