These Regulations continue in respect of Scotland to implement Council Directive 2008/90/EC on the marketing of fruit plant propagating material and fruit plants intended for fruit production and implement other EU legislation on fruit plant material. They also implement Commission Implementing Directive 2014/96/EU on labelling of fruit products, Commission Implementing Directive 2014/97/EU implementing Council Directive 2008/90/EC as regards the registration of suppliers and of varieties and the common list of varieties, and Commission Implementing Directive 2014/98/EU implementing Council Directive 2008/90/EC as regards specific requirements for the genus and species of fruit plants referred to in Annex I thereto, specific requirements to be met by suppliers and detailed rules concerning official inspections.
The Regulations, among other things - contain requirements for marketing plant material; require the registration of suppliers in a register of suppliers; deal with the enforcement and administration of these Regulations and set out powers of inspectors (appointed by the Scottish Ministers), including a power to serve a notice on any person to require that person to provide information and a power to prohibit the movement of plant material suspected of failing to comply with these Regulations. They also provide with respect to additional requirements for products to be used as genetically modified food or feed in accordance with Regulation (EC) No 1829/2003.
