These Measures intend to strengthen the supervision and administration of entry and exit traditional Chinese medicinal materials quarantine, prevent animal and plant epidemic diseases from spreading into or out of the country, protect the production of agriculture, forestry, animal husbandry, fishery and human health, and protect the ecological security. The Text consists of 58 Articles divided into 6 Chapters: General Provisions (I); Entry Quarantine Supervision and Control (II); Exit Quarantine Supervision and Control (III); Supervision and Inspection (IV); Legal Liabilities (V); Supplementary Provisions (VI).
The traditional Chinese medicinal materials referred to in these Measures mean the medicinal plants, medicinal parts of animals, and the raw medicinal materials formed after the primary processing. The General Administration of Quality Supervision, Inspection and Quarantine (AQSIQ) shall be responsible for the entry and exit traditional Chinese medical materials quarantine and the supervision and administration thereof. The Measures provides that the AQSIQ shall adopt the declaration system for the entry and exit traditional Chinese medicinal materials. Companies shall declare their expected use to the Inspection and Quarantine Department specifying medicinal or edible . Where declared as "medicinal", they should be the items included in the Pharmacopoeia of the People's Republic of China.
The AQSIQ shall adopt a quarantine access system for entry traditional Chinese medical materials, which includes product risk analysis, regulatory system evaluation and review, determination on the quarantine requirements, overseas manufacturing enterprise registration and entry quarantines.
Exit traditional Chinese medical materials shall comply with provisions of quarantine agreements, protocols and MoUs signed between the governments of China and the importing country or region, as well as the standards of importing country or region or the requirements of the contract. The production enterprises shall meet the relevant requirements of the laws and regulations of the importing countries or regions, comply with the relevant laws and regulations of China, and establish a sound system of epidemic prevention and a traceability management system.
