These Regulations make provision, in relation to Scotland, for the identification and remediation of contaminated land under Part 2A of the Environmental Protection Act 1990. They apply Part IIA of the Act in relation to pollution of the water environment which is attributable to radioactivity and make provision for Part IIA to have effect with modifications for the purpose of the identification and remediation of radioactive contaminated land.
The Scottish Environment Protection Agency (SEPA) shall inspect land where there are reasonable grounds for believing that it may be subject to radioactive contamination and shall advise a local authority on the identification of such land and the outcome of inspections. SEPA shall designate land contaminated by radioactivity as a special site and set out the procedure for notifying a designation. Other provisions of the Regulations concern remediation and powers of SEPA to investigate matters which may have given rise to harm or pollution of the water environment attributable to radioactivity.
