These Regulations aim to strengthen the protection of drinking water sources, improve drinking-water quality, ensure drinking water safety, protect public health and safety, and promote coordinated and sustainable development of economy and society in Shanghai Municipality. These Regulations are formulated in accordance with the Law of the People's Republic of China on Prevention and Control of Water Pollution and the Water Law of the People's Republic of China in the light of the actual circumstances of this Municipality. The Law is divided into 5 Chapters: General provisions (I); Protection of drinking water sources (II); Supervision and administration (III); Legal liabilities (IV); Supplementary provisions (V).
Drinking water sources mentioned in these Regulations refers to the surface water sources which are provided to tap water supply enterprises as raw water. Shanghai municipal competent environmental protection authority shall be responsible for the unified supervision and administration over the protection of the drinking water source in the Municipality. The drinking water source protection plan shall be formulated by the municipal competent authority and relevant administrative departments. The protected areas of the drinking water source shall be classified as Class I and Class II Reserves, and a quasi-reserve of certain extent may be delimited outside of the protected area, if necessary. The activities which are forbidden in drinking water source reserves and quasi- reserves are listed respectively in Chapter 2. Where projects related to water supply facilities and water source protection are constructed in Class I Reserves of drinking water sources, or projects with no drainage of pollutants are constructed in Class II Reserves of drinking water sources, the environmental impact evaluation documents shall be examined and approved by the municipal environmental protection authority. The ecological protection compensation system, water quality monitoring information and safety evaluation system shall be established for drinking water sources. Final provisions establish the penalties to be applied in case of violation.
