The purpose of these Provisions is to implement the Renewable Energy Law of the People s Republic of China, standardize the administration of renewable energy power generation projects, and promote the rapid development of renewable energy power generation industry. The Text consists of 22 Articles divided into 5 Chapters: General Provisions (I); Project Management (II); Responsibilities of the Grid Enterprises (III); Responsibilities of the Power Generating Enterprises (IV); Supplementary Provisions (V).
Renewable energy referred to in these Provisions include power generation from hydro, wind, biomass (including power generation from forest and agricultural waste through direct combustion and gasification, solid waste incineration, landfill gas, biogas), solar, geothermal and ocean power generation (art.2).
The National Development and Reform Commission is responsible for the planning and policy formulation for renewable energy power generation projects across the country as well as the administration of projects subject to state review and approval (atr.9).
Chapter 2 addresses issues of project management, investment approval, price administration and operation monitoring, etc. Chapter 3 provides for the requirements to be satisfied by the grid enterprises, including: requirements for planning, grid construction and construction of interconnection system.
According to Chapter 4, power generating enterprises shall actively invest and construct renewable energy power generation projects and undertake the obligation of mandatory quota generated from renewable energy in the energy mix as specified by the state (art.14). Power generation enterprises shall conscientiously perform preparatory work such as design, land use, water resources and environmental protection according to state regulations on renewable energy power generation project management, and lawfully obtain administrative licenses. Construction shall not be kicked off without license or permit (art.16).
The Provisions further provide for dispute and arbitration, violation and penalty in Chapter 5.
