The Law may be cited as the Air Quality (Amendment) (No. 2) Law of 2005 and shall be read as one with the Air Quality Law of 2002-2004 (hereinafter referred to as "the principal Law"). The principal Law and the present Law shall be read as one and will be referred to as the Air Quality Laws, 2002-2004 (Amendment No. 2). With the purpose of implementing art. 7(1) of Directive 2002/3/EC of the European Parliament and of the Council relating to ozone in ambient air, this Law carries forward amendments to the basic law by amending article 12 (adding section 3) as follows: "In cases where there is a risk of exceedances of the alert threshold, the provisions mentioned above may not apply, if the Minister, taking into account the national geographical, meteorological and economic conditions, identify that there is no significant potential for reducing the risk, duration or severity of any exceedance".
