These Measures are formulated in accordance with the Law on the Protection of Wildlife, the Fisheries Law and the Regulation on Natural Reserves, aiming to strengthen the construction and administration of nature reserves for aquatic plants and animals. The Measures consist of 32 Articles divided into 5 Chapters: General provisions; Construction of Aquatic Animal and Plant Nature Reserves; Administration of Aquatic Animal and Plant Nature Reserves; Penalties; Supplementary provisions.
Nature reserves for aquatic plants and animals shall include national nature reserves for aquatic plants and animals and local nature reserves for aquatic plants and animals. The establishment of a national nature reserve for aquatic plants and animals shall obtain the approval of the provincial people's government, and shall be reported by the fishery administrative department of the State Council to the State Council for approval. A nature reserve for aquatic plants and animals shall be established if an area meets any of the conditions prescribed in Article 6, including: (1) Being a concentrated distribution area, a main habitat or a breeding ground of aquatic plants and animals under the state's and local particular protection; (2) Being an area with the typical ecosystem of aquatic plants and animals across different natural zones; (3) Being a main place of origin of particularly important aquatic economic plants and animals of the state (4) Being an important concentrated distribution area with diversified aquatic plant and animal species; (5) Being a natural habitat for aquatic species, which has suffered no or little damage caused by human beings, and has its natural state maintained in good condition; (6) Being an aquatic organism ecological environment of special conservation value.
The review committee on nature reserves for aquatic plants and animals under the fishery administrative department of the State Council shall be responsible for the review of the applications for the establishment of national nature reserves for aquatic plants and animals.
