The purpose of these Measures is to protect, develop and utilize aquatic wildlife resources, strengthen the protection and management of aquatic wildlife, and regulate the issuance and use of relevant special licenses. The Measures are divided into 7 Chapters: General Provisions (I); Capture Management (II); Domestication and Breeding Management (III); Business Operation Management (IV); Transport Management (V); Import and Export Management (VI); Supplementary Provisions (VII).
The aquatic wild animals mentioned in the present Measures refer to precious and endangered aquatic wild animals; the term aquatic wildlife products refers to any part or derivative of precious or endangered aquatic wild animals.
The special licenses for the state grade 1 protected aquatic wildlife or their products shall be examined and approved by the Ministry of Agriculture. The provincial department of fishery administration is responsible for the administration of the special licenses for the state grade 2 protected aquatic wildlife.
The capture or killing of aquatic wildlife is prohibited. In special circumstances such as scientific research, teaching, domestication and breeding, exhibition, donations where it is necessary to capture aquatic wildlife, the aquatic wildlife capture special license must be obtained (art. 8). Before being engaged in domestication and breeding of aquatic wildlife, the special license for aquatic wildlife domestication and breeding shall be applied and approved by the competent authorities at the provincial level or above (art.15). The sale or purchase of aquatic wildlife are prohibited. In special circumstances such as scientific research, teaching, domestication and breeding, exhibition, donations where it is necessary to sell, purchase and exploit aquatic wildlife, the application for the special license for aquatic wildlife business must be examined and approved by the competent fishery authorities at the provincial level or above (art.22). The Measures provide further for the aquatic wildlife transport special licenses, the special permit for aquatic wildlife export and import, the application procedures, and offences and penalties.
