These Regulations apply to the importation and exportation of species of fauna and flora, in accordance with the provisions contained in the Convention on International Trade in Endangered Species of Wild Fauna and Flora, as well as European Union Regulations 338/97/EC and 1808/2001/EC. The Malta Environment and Planning Authority is designated to be the Management Authority and therefore shall be responsible for the implementation of the above-mentioned Convention and Regulations. Any person seeking to import, export or re-export any specimen shall apply in writing to the Management Authority. According to regulation 6 (3), the importation of any species which is protected at the country of origin, even if not listed in the Annexes to Regulation 338/97/EC, and even if that country of origin is not a party to the above-mentioned Convention, shall require an export authorization from that country.
