An incidental take is a take (that is to harass, harm, pursue, hunt, shoot, wound, kill, trap, capture, or collect, or to attempt to engage in any such conduct) that results from activities that are otherwise lawful (Source: draft based on Endangered Species Act, USA). The concepts also refers to migratory birds, their nests and eggs that can be inadvertently harmed or disturbed as a result of many activities (such as clearing trees and other vegetation, draining or flooding land, or using fishing gear), which can have long-term consequences for migratory bird populations.
