The Act provides for implementation of the EU Regulations on the protection of specimens of wild animal and plant species by monitoring its trade. The Federal Ministry for Agriculture, Forestry, Environment and Water Management is subject to licensing requirements for trade in specimens. The Act further provides for acquisition of the specimens by inheritance or gift and liabilities of the new owner. The text further lays out provision for labelling, registration and identification the specimens. Article 6 refers to responsible authorities for controlling, evidence providing and preserving and customs requirements. The Act further refers to criminal and financial offences, penal order, seizure and treatment of confiscated specimens. The Federal Ministry for Agriculture, Forestry, Environment and Water Management is in charge for enforcement of this Act and relevant EU regulations. The text consists of 16 Articles.
An Act to implement the Community Law on custom control of wild flora and fauna. However, the Federal Minister for Economic Affairs is empowered to issue more severe regulations than those established by Community law (art. 2). Article 4 establishes that for every living item the time of arrival has to be communicated to the competent customs authority 18 hours before its arrival.
