This Regulation lays down rules for the prevention and control of animal diseases which are transmissible to animals or to humans. These rules aim to ensure (i) improved animal health to support sustainable agricultural and aquaculture production in the European Union; (ii) the effective functioning of the internal market; and (iii) a reduction in the adverse effects on animal health, public health and the environment of certain diseases. The Regulation takes into account not only the relationship between animal health and public health, the environment (including biodiversity and valuable genetic resources, as well as the impact of climate change), food and feed safety, animal welfare, antimicrobial resistance and food security; but also the economic, social, cultural and environmental consequences arising from the application of disease control and prevention measures.
Part I lays down general rules which provide in particular for the prioritization and categorization of diseases of European Union concern and for the establishment of responsibilities for animal health (arts. 1-17).
Part II sets out detailed tules on disease notification and reporting, surveillance, eradication programme and recognition of disease-free status. Further, Part III regulates disease awareness, preparedness and control. Emergency measures are laid down under Part VII, giving special regard to movements of animals and products within the Union and means of transport and other material that may have come into contact with such animals and products.
Part IV establishes the registration and approval of establishments and transporters, movements and traceability of animals, germinal products and products of animal origin within the European Union. As a general rule, article 84 establishes the obligation of operators to register establishments keeping terrestrial animals or collecting, producing, processing or storing germinal products.
Part V regulates the entry into the European Union and the export of animals, germinal products and products of animal origin from third countries and territories. The Commission may draw up lists of third countries and territories from which the entry into the Union of specific species and categories of animals, germinal products and products of animal origin is to be permitted (based on the criteria specified in article 230). Detailed provisions are laid down as regards animal health certificates, declarations and other documents for entry into the Union.
